Once again we see a move by government to restrict employment practices (“Job reservation is on the cards, government confirms,†February 13).
Economists tell us the employment of foreign nationals in SA is less than 3% of our workforce. How this restriction is going to tackle SA’s record unemployment is therefore a mystery.
Applying for critical skills work visa in South Africa as an artisan has been a challenge for the longest time. In 2014 when the current amendments to the Immigration Act were gazetted several gaps were identified in the Act which included the absence of a SAQA accredited professional body to register artisans. ECSA was not an option due to their minimum NQF criteria of 5 which was a notch above the rating being given by SAQA for artisans. There was a time letters issued by the National Artisan Moderation Body, (NAMB), were sufficient and then they were not.
The updated South Africa Critical Skills List was published by the Minister of Home Affairs. It is exciting to see a number of new critical skills being listed that will prove beneficial to companies in a range of industries including IT, engineering and financial services, wishing to bring key talent into the country.
The List provides an opportunity for South Africa’s economical and developmental needs to be met, while at the same time creating job opportunities via skill transfers to locals.

Home Affairs has opened services for South Africans but asylum seekers remain shut out
Refugees and asylum seekers want the Home Affairs Refugee Reception Office in Durban to reopen. It has been closed for nearly two years.
• Refugee organisations are asking Home Affairs to reopen its Refugee Reception Offices.
• The offices have been closed to asylum seekers since March 2020.
• Home Affairs offices have reopened services for South Africans but not for refugees.
• Since 2016, foreign students who graduated in South Africa in a critical skills field would get a permanent residency permit without needing work experience.
• But these waivers were recently revoked, in the same week that the department of home affairs gazetted South Africa`s new critical skills list.
• Additionally, critical skills visas won`t be available to skilled foreigners looking for work, as was previously the case.
South Africa is considering the adoption of a remote-working visa as part of a push to attract more skilled workers, and their money, to the country.
Remote-working visa are travel permits that legalise the status of travelling professionals. Like tourist visas, they are easy to obtain and do not require long

Almost 18,000 illegal foreign nationals have been held incarcerated in the country’s correctional facilities in the past five years. Of these, about 52% were sentenced by November 2021.
Justice & correctional services minister Ronald Lamola gave the figures in a written parliamentary response after DA MP Désirée van der Walt had inquired about the number of illegal foreign nationals held between 2017 and 2021.

A person will be declared ‘undesirable’ and will receive a ban regardless of the reason for the
overstay. The ban applies to any person who has overstayed, adults and children. The ban and
being declared ‘undesirable’ also affects people who leave South Africa while their application for
a visa (or visa extension) is pending, if their current visa has expired. SA
