President Cyril Ramaphosa says when employers knowingly hire undocumented foreign workers, they contribute towards social tensions between citizens and foreign nationals in the country. `I want to take this occasion to address employers in this country, including in hospitality, agriculture, transport and other labour-intensive sectors. When employers knowingly hire undocumented foreign workers, they are breaking the law,` the President said on Monday. He made these remarks during the 2022 Human Rights Day national event at the Reagile Community Centre in Koster, North West.

South Africa is the destination of choice for many people from the continent and the world. As a result of this the country’s ports receive millions of travellers annually entering for various reasons. However, on occasion a traveller is refused entry having been deemed ineligible for entry into the Republic for one or more reasons. Often persons who find themselves in this position are summarily sent back to their country of embarkation without being informed of their rights if any under our law and how to exercise these rights. In this week’s piece we will explore what the Immigration Act provides for persons in this position as well as what our courts have concluded in cases involving persons who have been refused entry.

Home Affairs Minister Aaron Motsoaledi says they are trying to clamp down on illegal foreigners through their inspectorate, but statistics show there are close to 4 million foreigners in the country. Motsoaledi said the inspectorate had been able to deport 14 113 undocumented foreign nationals between April and December last year. This followed 211 inspections in the country. But during another operation on the borders between January last year and this January the department deported 14 337 people who were trying to get into the country illegally.

The formal sector normally use documented migrants and register them appropriately, but sectors in `obscure places` of in SA employ un-documented migrants, says the DEL. • The Department of Employment and Labour briefed Parliament`s Portfolio Committee on Tourism about migration trends. • Especially since 2000, there has been a `dramatic influx` of mainly undocumented migrant workers, a worrying trend for the DEL. • These migrants are particularly concentrated in the informal sector.

Home Affairs minister Aaron Motsoaledi has updated which services will be available at Home Affairs offices during the country’s adjusted level 1 lockdown. In a government gazette published at the end of February, Motsoaledi said that this will include: • Births registration; • Late registration birth; • Re-issuance of birth and marriage certificates; • Applications for unabridged birth, marriage and death certificates, including vault copies;

The bidding process for a visa and permit applications management tender worth R50 million closed on 25 February 2022. Home affairs minister Aaron Motsoaledi’s confirmed the closing date in response to questions asked by the Democratic Alliance’s Adrian Roos. The current contract, awarded to VFS Global in December 2010, expires in December this year. The new contract is valued at R50 million according to the tender document. According to Motsoaledi, the current bid specifications for the appointment of a project officer to manage the project were approved by the Bid Specification Committee on 9 February. Roos also asked if there would be an alternative review process other than a formal appeal by VFS.

Nearly 180 000 Zimbabwean Exemption Permit (ZEP) holders living in South Africa face deportation at the end of this year if they are unable to find an alternative permits that will allow them to remain in the country. Most ZEP holders are unlikely to qualify for the critical skills list published on February 2 2022 by Home Affairs Minister Dr Aaron Motsoaledi. They say the grace period the Cabinet announced in November last year was too short for them to uproot their lives. The ZEP was introduced in 2017, replacing a series of earlier permits to regularise Zimbabweans living in South Africa since 2010.

Employment and Labour Minister Thulas Nxesi released the National Labour Migration Policy for public comment on Monday afternoon. • This will introduce new employment quotas on foreign workers, as well as ban foreigners from starting small businesses in some sectors. • `Migrants are in particular concentrated in informal sector â€` a worrying trend,` government said in a statement.
