More than 41,500km and R150,000 later, a Rustenburg man still hasn’t got his Ukrainian wife and son home. A South African man has so far travelled 41,500km and spent more than R150,000 trying to get his new Ukrainian wife and three-year-old son into South Africa and out of danger back home. But because of the intransigence and apparent confusion of South African immigration authorities, she and their son are still in Ukraine, just as it faces a new offensive from Russia.

With the lifting of the national state of disaster, the Department of Home Affairs says it will now reopen in-person services for refugees. Since 26 March 2020 there has been no way for refugees to apply for asylum. after closing in-person services due to the Covid pandemic, the Department of Home Affairs has announced it is reopening its Refugee Reception Offices. Since 26 March 2020, there has been no way for refugees to apply for asylum, and people who already had refugee or asylum-seeker status were unable to renew or replace their permits and papers. The “family joining” process â€` granting refugee status or a similar secure status to family members accompanying a recognised refugee â€` had also stopped. Consequently, refugees have struggled to access basic services, enrol their children in schools, open bank accounts or legalise their presence in the country.

The fact that we don’t actually know how many ‘undocumented’ migrants there are is, in part, attributable to a systemic problem of state administration with the Department of Home Affairs. Kopanang Africa Against Xenophobia had planned a demonstration on Human Rights Day 2022 across South Africa, but alas it was banned by the Johannesburg Metropolitan Police Department (JMPD). The aim of the ban was to avoid conflict since those involved in Operation Dudula had threatened to attack the anti-xenophobia march. The JMPD could not guarantee the safety of both sides in a possible confrontation fueled by a concoction of mistruths and misperceptions about non-nationals being responsible for unemployment, crime and poverty in South Africa.

The Prime Minister wants to see the first migrants handed a ‘one-way ticket’ to Rwanda flown out in roughly six weeks as the Government battles to curb Channel crossings. What is a Ministerial Waiver / Exemption and how does it work Upon application to the Minister of Home Affairs, the Minister may under terms and conditions determined by him or her allow distinguished visitors or members of his/her family to be administered and sojourn in South Africa and or waive any prescribed (regulatory) requirements for good cause and/or grant any foreigner or category of foreigners the rights of permanent residence for a specified or unspecified period when special circumstances exist justifying such a decision.

R e c o g n i s ed R e f u g e e ( S e c t i o n 2 4 P e r m i t ) This means that : A refugee can apply for permanent residence if he or she has been living in South Africa on a refugee status permit for a minimum of five consecutive years.143 For a recognized refugee to receive a permanent residence permit, the standing committee for refugee affairs must have certified that that person will remain a refugee “indefinitely.”
